ACTION BULLETIN
TO: All Workforce Investment Act Program Operators
DATE: April 6, 2001
SUBJ: WIA Fund Utilization Policy
Purpose of Bulletin:
The Workforce Investment Board is responsible for ensuring that the WIA funds are utilized appropriately and for transmitting a policy informing its program operators of the statutory prohibitions.
Citation(s): Each citation is listed below with the respective prohibition.
Policy:
No WIA funds may be used for the following:
1. Public service employment; {WIA 195(10); 20 CFR 667.264} 2. Relocation of a business or part of a business that results in the loss of employment at the original location; {WIA 181(e); 20 CFR 667.262} 3. Employment generating activities; {WIA 181(e); 20 CFR 667.262} 4. Political activities; {WIA 195 (6)} 5. Duplication of facilities/services available in the area; {WIA 195(2); 20 CFR 663.320} 6. Employment or training of participants in sectarian activities; {WIA 188(a)(3); 20 CFR 667.266} 7. Charging participants a fee for placement or referral into a training program; {WIA 195(5)} 8. Payment of wages to incumbent employees; {WIA 181(b)(1); 20 CFR 667.264} 9. Displacement of employees by any WIA participants; {WIA 181(b)(2) and (3); 20 CFR 667.270} 10. Action:
WIA program operators are responsible for bringing this policy to the attention of all appropriate parties including program administrative, financial, and service delivery staff. Furthermore, if any WIA funds have been sub-contacted, program operators are required to provide those organizations a copy of this policy and ensure subcontractor compliance.
