SUBJECT: Requesting an Exception to Residency Requirement Procedure


PURPOSE OF BULLETIN:
The purpose of this bulletin is to provide instructions to request an exception to the Residency Requirement.

BACKGROUND:
Action Bulletin AB - #37 provided information on the implementation of a redefined Priority of Service – Residency Requirement for the Workforce Investment Act (WIA) Title I Adult and Dislocated Worker programs. At the May 13, 2004 meeting, the Alameda County Workforce Investment Board (WIB) adopted a new Residency Policy that states:

1. Resides in the Alameda County Workforce Investment Area (LWIA) or
2. Works in an employer facility located in the Alameda County Workforce Investment Area or
3. Has worked (during the last 6 months) in an employer facility located in the Alameda County Workforce Area.
4. Allow an exception to the new policy on a case-by-case basis for extraordinary circumstances.
5. Implement new policy beginning July 1, 2004.

The Alameda County LWIA includes the 16 cities of: Alameda, Albany, Berkeley, Castro Valley, Dublin, Emeryville, Fremont, Hayward, Livermore, Newark, Piedmont, Pleasanton, San Leandro, San Lorenzo, Sunol, and Union City, including the unincorporated areas of Ashland, Cherryland and Fairview.

The Bulletin included an Exception Policy: Exceptions to this policy will be granted, with WIB program liaison approval, to allow for the provision of service to customers who reside outside the Alameda County Workforce Investment Area (on a case-by-case basis for extraordinary circumstances).

1. Residency outside the Alameda County Workforce Investment area must be documented.
2. The One Stop Career Center Site Manager, or programs’ designee, must submit, in writing, a request for exception to the WIB program liaison. A copy of the program liaison approval response must be in the eligibility file upon submission for eligibility review.

Case files received by the Certification/Information Processing Unit without program liaison approval will be returned to the intake worker before completion of eligibility certification.

PROCEDURE FOR REQUESTING AN EXCEPTION:
In evaluating the need for program liaison approval of Request for Exceptions it was determined that a more efficient approach was warranted to ensure objectivity and timeliness of approval.

Therefore, One Stop Career Centers/Providers will be allowed to enroll:

1. Up to 5% of their total enrollments, per grant, beginning with PY 2004-05 enrollment statistics, clients who reside or work outside of Alameda County Local Workforce Investment Area (LWIA).
2. Clients must have extraordinary circumstances that require service by your local service area.

Based on contractual goals by Center/Provider those with higher contractual goals will be allowed a higher number of enrollees who live or work outside the LWIA. ACWIB felt it was equitable and reasonable to provide optimum responsibility to the Center/Provider to determine which customers would be submitted as exceptions.

The attached form, “Request for Exception to Residency Requirement”, will be completed and faxed to Linda Slater, MIS Administrator, prior to submittal of the complete eligibility file for eligibility review. Ms. Slater will confirm number of enrollments, by grant, and number of prior requests for exception. If the numbers indicate that the One Stop/Provider enrollments meet the criteria of 5% then the request will be approved. If not, it will be denied.

Please ensure that the extraordinary circumstances are stated and that the Site Manager or other program manager, has signed and dated the form, along with all the pertinent information regarding the customer. MIS will not be approving or denying a request based on extraordinary circumstances, but the reasons will be evaluated and reviewed by the ACWIB staff as we review the effectiveness of the redefined residency requirement.

All sections MUST BE COMPLETE prior to the Exception to the Residency Policy being granted.

Effective July 1st, 2004, the Local Workforce Investment Area (LWIA) of the Alameda County WIB (ACWIB) will be defined as: Alameda County excluding the City of Oakland. ACWIB Policy states that beginning July 1, 2004 all ACWIB Adult & Dislocated Worker participants must fall under one of the following four categories: 1)On the date of application he/she resides within the ACWIB LWIA; or 2)On the date of application he/she works for a company located within the ACWIB LWIA; or 3)He/she has worked for an employer located within the ACWIB LWIA during the six months prior to his/her application date; or 4)He/she has been granted an "exception" by WIB Staff due to extraordinary circumstances. Exceptions will be granted on a "5% basis". That is that one exception may be granted for every 20 enrollments (as indicated by the JTA system on the date of request.
