SUBJECT: Alameda County Workforce Investment Area
Purpose of Bulletin:
The WIA provides local workforce investment areas the flexibility to implement procedures and definitions that best suit the needs of local communities.
The Workforce Investment Act (WIA) defines an out-of-school youth as: · an eligible youth who is a school dropout; or · an eligible youth who has received a secondary school diploma or its equivalent but is basic skills deficient, unemployed, or underemployed (WIA sec. 101(33)). A school dropout means an individual who is no longer “attending any school” and who has not received a secondary school diploma or its recognized equivalent (WIA sec. 101(39)).
The WIA did not define “attending any school” but stated that the State and/or local level have the flexibility to further define this phrase.
On December 12, 2002, the Alameda County Workforce Investment Board (WIB) approved the definition of “attending any school” for the WIA Youth programs. The purpose of this bulletin is to relay the definition to the Youth Collaboratives and the One Stop Career Centers responsible for implementing the WIA Youth Programs. The definition of “attending any school” was developed by WIB staff in conjunction with the Youth Collaboratives. Staff attended training sponsored by the State’s Capacity Building Unit to receive further clarification on defining “attending any school” in relation to out-of-school youth. The State provided Department of Labor Training and Employment Guidance Letters to assist local workforce investment areas in defining “attending any school”.

Policy/Procedure/Definition:
The eligibility definition for out-of-school youth will include the following local definition of attending any school in the determination of eligibility for registrants requesting services under Title IB of the Workforce Investment Act (WIA).
Approved Definition
The phrase “attending any school” excludes community-based organization educational programs and Vocational English as a Second Language.
Action:
The Youth Collaboratives and the One Stop Career Centers use this definition in the determination of eligible out-of-school youth and to guard against serving ineligible applicants.
