SUBJECT: Priority of Service - Residency Adult and Dislocated Worker Programs
PURPOSE OF BULLETIN:
The purpose of this bulletin is to provide information and instructions for implementation of a Priority of Service – Residency requirement for the Workforce Investment Act (WIA) Title I Adult and Dislocated Worker programs. Residency requirements will not apply to discretionary grants or programs.
At the September 12, 2002 meeting, the Alameda County Workforce Investment Board (WIB) rescinded the Policy for Workforce Investment Act (WIA) Registrants adopted at the June 2001 Workforce Investment Board (WIB) meeting that states “residency will no longer be a requirement for intensive and training services, and will be considered only when funds are limited.” Thereby reinstating the Priority of Service policy adopted by the WIB in September 2000.
The WIB then took action to amend the September 2000 Priority of Service policy that limits WIA funded service to Adult and Dislocated Worker customers who reside “within the local Workforce Investment Area (Alameda County, excluding the City of Oakland)”.
The approved Priority of Service funds service for:
1. Adults and Dislocated Workers who, on the date of application, reside within the EASTBAY Works Regional Area (Alameda County and Contra Costa County inclusive). Or 2. Dislocated workers laid off, due to substantial layoff or plant closure, from a facility located within the EASTBAY Works Regional Area (Alameda County and Contra Costa County inclusive). Or 3. By exception, Adults and Dislocated Workers, who on the date of application, reside outside the EASTBAY Works Regional Area (Alameda County and Contra Costa County inclusive). Exceptions require a Site Manager or designee signature and will be on a case-by-case basis.

BACKGROUND:
The Workforce Investment Act of 1998 allows local boards to establish priorities of service. In September 2000, the WIB approved “residency” within the local Workforce Investment Area (defined as Alameda County excluding Oakland) as the local priority of services for receipt of intensive and training services. This would apply to WIA Title I Formula Grants for adult and dislocated workers. (Attachment VI.F.2.)
In June 2001, the WIB reconsidered and determined that residency would no longer be a requirement for intensive and training services and would be considered only when funds are limited. This “no residency” policy allowed for increased flexibility and greater customer choice. (Attachment VI.F.1.)
When the September 11th tragedy occurred, the economy of California drastically changed the demand for services. Several of the other local Workforce Investment Areas (LWIAs) within the greater Bay Area, such as San Jose WIB, San Mateo WIB, and the NOVA Consortium exhausted their training funds early in the program year, due to labor demand. They then began referring customers to our One Stop Centers because Alameda County WIB has no residency requirements. The referral trend continues even though new funding has been allocated with the new fiscal year. Many of the referrals are from the high tech industry wanting high cost training.
In an attempt to balance service to eligible customers residing within our local area, or who have been laid off from facilities located within our local area, WIB staff recommended the changes in the residency policy. The changes recognize the EASTBAY Works Regional Area as the local service area to reflect movement of customers among the 14 One Stop Career Centers. The Exception Policy will be instituted as written, but evaluated, in conjunction with the One Stop Career Centers, and presented to the WIB as an information item in December 2002.
ELIGIBILITY REQUIREMENT:
Documentation of Residency for Adults and Dislocated Workers who reside in or are laid off, due to substantial layoff or plant closure, from a facility located “within the EASTBAY Works Regional Area (Alameda County and Contra Costa County inclusive) will be required as part of the eligibility intake process and included in a complete case file. Residency documentation will be required upon submission of new eligibility intake files to the Certification/Information Processing Unit (C/IPU) as of Monday, September 30, 2002. Files in process as of Friday, September 27, 2002 will not be required to submit residency documentation.
CRITERION ACCEPTABLE DOCUMENTATION RESIDENCYResidency Priority –All enrolled registrants must reside in or be laid off due to substantial layoff or plant closure from a facility located within the EASTBAY Works Regional Area, (Alameda and Contra Costa Counties inclusive).NOTE: The listed items of documentation are acceptable for any individual listed on the grant.For the purpose of this section, “Current” is defined as, “issued no more than 30 days from the date of application or the most current for the type of document. -Un-expired California Driver’s License or State ID with applicant’s address, at time of application, pre-printed on the front, or on the back with the DMV “Change of Address Notification” stamp. -Social Services Printout for any applicant who is an eligible family member on an active case.-Current bill or statement (utility, medical, financial institution)-Current School Letter -Current Rent Receipt with pre-printed address and name and phone number of landlord or property manager. -Current Shelter Letters for homeless residency-Current Employer Letter, pay stub, or Lay Off notice-EDD Printout with Employer Address-Lay Off or Separation Papers with Employer Address-Warn notice with employer address and employee check stub or employee ID-General Announcement of Closure with Employer Address
EXCEPTION POLICY
The Exception Policy, with Site Manager or designee approval, allows provision of service to customers who reside outside the EASTBAY Works Regional Area on a case-by-case basis.
1. Residency outside the EASTBAY Works regional area must be documented. 2. The One Stop Career Center Site Manager, or designee, must initial and date the residency box on the Document Checklist to indicate that they are approving the waiver of residency for this particular customer. 3. Case files received by the Certification/Information Processing Unit without Site Manager approval will be returned to One Stop intake worker for site manager signature before completion of eligibility certification.
